1. Acceptance of Terms
Welcome to Wambesha. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wambesha LLC ("Wambesha," "we," "us," or "our"), a New Mexico Limited Liability Company.
By accessing or using our streaming platform, website, mobile applications, or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
IMPORTANT: These Terms include an agreement to resolve disputes through binding arbitration and a waiver of class action rights. Please read Section 12 carefully.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
Users under 18 may only use the Service through a parent or legal guardian's account and with their supervision. The account holder is responsible for all activity under their account, including content accessed by minors.
3. Service Description
Wambesha provides a subscription-based streaming entertainment service that allows users to:
- Stream movies, television shows, documentaries, and original content
- Create personalized user profiles with customized recommendations
- Download select content for offline viewing on compatible devices
- Access content across multiple devices simultaneously (based on subscription tier)
- Enjoy content in various quality levels up to 4K Ultra HD with HDR support
Content availability varies by geographic location due to licensing agreements. We reserve the right to add, remove, or modify content at any time without notice.
4. User Accounts
4.1 Account Creation
To access most features of the Service, you must create an account by providing:
- A valid email address
- A secure password
- Your name and payment information
- Optional: mobile phone number for enhanced security features
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information remains current
We strongly recommend enabling Two-Factor Authentication (2FA) for enhanced account security.
4.3 Account Sharing
Your account is for your personal use and members of your household. Account credentials may not be shared with individuals outside your household. We reserve the right to limit the number of devices that can stream simultaneously and to take action against accounts that violate these sharing policies.
5. Subscription and Billing
5.1 Subscription Plans
We offer various subscription tiers with different features, including:
- Number of simultaneous streams allowed
- Video quality options (SD, HD, 4K Ultra HD)
- Number of user profiles
- Download capabilities
5.2 Billing
By subscribing to Wambesha, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless you cancel before the renewal date.
5.3 Price Changes
We may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We generally do not provide refunds for partial billing periods, except as required by applicable law.
6. SMS Communications Policy
TCPA COMPLIANCE NOTICE: This section describes how Wambesha uses SMS text messaging in compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and wireless carrier requirements.
6.1 Types of SMS Messages
By providing your mobile phone number and consenting to receive SMS messages, you may receive the following types of communications from Wambesha LLC:
Transactional Messages (No separate consent required):
- Two-Factor Authentication (2FA) codes - Security verification codes for account access
- Account security alerts - Notifications of suspicious activity or security changes
- Payment confirmations - Receipts and billing notifications
- Service updates - Important changes to your account or service
Marketing Messages (Separate consent required):
- Special offers and discounts
- New content announcements
- Feature updates and enhancements
- Exclusive subscriber promotions
6.2 Two-Factor Authentication (2FA) Disclosure
When you enable Two-Factor Authentication on your Wambesha account, you consent to receive automated security verification codes via SMS to the mobile phone number associated with your account.
Purpose: 2FA messages verify your identity when:
- Logging in from a new device or browser
- Accessing your account from an unrecognized location
- Performing sensitive account actions (password changes, payment updates)
- Resetting your password
Message Format Example: "Your Wambesha verification code is: 123456. This code expires in 10 minutes. If you did not request this, contact support@wambesha.com"
6.3 Message Frequency Disclosure

Actual message frequency varies based on your account activity and preferences.
6.4 Opt-In Procedures
For Transactional Messages:
By creating a Wambesha account and providing your mobile phone number, you consent to receive transactional SMS messages necessary for account operation and security.
For Marketing Messages (Double Opt-In Required):
- During registration or in account settings, check the box labeled: "I consent to receive promotional SMS messages from Wambesha"
- You will receive a confirmation SMS: "Reply YES to confirm you want to receive promotional messages from Wambesha. Msg frequency varies. Msg & data rates may apply. Reply STOP to cancel."
- Reply YES to complete your opt-in
- You will receive confirmation: "You are now subscribed to Wambesha promotions! Reply HELP for help, STOP to cancel."
Consent is not required as a condition of purchase. You may use the Service without subscribing to marketing messages.
6.5 Opt-Out Procedures
You may opt out of SMS messages at any time using any of these methods:
Method 1: Text Message
Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message we send.
You will receive confirmation: "You have been unsubscribed from Wambesha messages. No more messages will be sent. Reply HELP for help."
Method 2: Account Settings
Log in to your Wambesha account and navigate to Settings > Communication Preferences > SMS Notifications to manage your preferences.
Method 3: Email
Send an email to support@wambesha.com with the subject "SMS Opt-Out" including your phone number.

Important Notes:
- Opting out of marketing messages does NOT opt you out of transactional messages (2FA, security alerts, payment confirmations)
- To disable 2FA messages, you must disable 2FA in your account security settings
- After opting out, you may receive one final confirmation message
- Opt-out requests are processed immediately
6.6 Help and Support
For assistance with SMS messages, text HELP to receive:
"Wambesha LLC: For help, visit wambesha.com/help or email support@wambesha.com. Msg & data rates may apply. Reply STOP to cancel."
6.7 Carrier Fees and Supported Carriers
Message and data rates may apply. These charges are billed by your wireless carrier and are not charged by Wambesha. Contact your wireless carrier for details about your messaging plan.
Supported carriers include (but may not be limited to): AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and other major U.S. carriers.
Wambesha is not responsible for any delays or failures in message delivery caused by wireless carrier networks.
6.8 Third-Party Service Provider
SMS messages are delivered through Twilio, Inc., our authorized communications service provider. Twilio processes your phone number and message data solely for the purpose of delivering messages on our behalf.
7. Content and Intellectual Property
7.1 Our Content
All content available through the Service, including but not limited to movies, TV shows, graphics, logos, and software, is owned by Wambesha or our licensors and is protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view content through the Service for your personal, non-commercial use only. You may not:
- Copy, reproduce, distribute, or publicly display any content
- Modify, adapt, or create derivative works
- Circumvent, disable, or interfere with security features
- Use any automated means to access the Service
- Download content except through authorized features
8. User Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Share, sell, or transfer your account access
- Use VPNs or proxies to circumvent geographic restrictions
- Record, capture, or redistribute any content from the Service
9. DMCA and Copyright Policy
Wambesha respects the intellectual property rights of others. If you believe that content on our Service infringes your copyright, please submit a DMCA takedown notice to our designated agent:

10. Disclaimers and Limitations
10.1 Service Availability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted or error-free service.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAMBESHA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10.3 Indemnification
You agree to indemnify and hold harmless Wambesha, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of subscription fees
- Extended periods of inactivity
Upon termination, your right to use the Service ceases immediately, and you must delete any downloaded content.
12. Dispute Resolution
12.1 Informal Resolution
Before initiating any legal action, you agree to contact us at legal@wambesha.com and attempt to resolve the dispute informally for at least 30 days.
12.2 Binding Arbitration
Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Albuquerque, New Mexico, or another mutually agreed location.
12.3 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED INDIVIDUALLY, NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions against Wambesha.
12.4 Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
13. Accessibility
Wambesha is committed to making our Service accessible to all users, including those with disabilities. We strive to conform to WCAG 2.1 Level AA standards. If you experience any accessibility issues, please contact us at accessibility@wambesha.com.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
